According to the Illinois Criminal Code, criminal sexual assault refers to an act of sexual penetration in which the perpetrator:

  • Used or threatened the use of force;
  • Knew that the victim was not able to give consent or understand the nature of the act;

  • Was at least 17 years old and in a position of authority over the victim. (The victim must be at least 13 and under age 18.)
